General Terms and Conditions (GTC)
1. Scope of Application
These GTC apply to all orders placed through our online shop in the version valid at the time of the order.
2. Contractual Partner, Conclusion of Contract
The purchase contract is concluded with Lian Chinaherb AG. By placing products in the online shop, we make a binding offer to conclude a contract for these items. You may place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided during the ordering process. The contract is concluded when you submit a binding order by clicking the order button, thereby accepting the offer for the goods in the shopping cart. Immediately after submitting your order, you will receive a confirmation by e-mail.
3. Contract Language, Storage of Contract Text
The languages available for the conclusion of the contract are German, French and English. We store the contract text and send you the order details and our GTC by e-mail. You may view and download the GTC at any time on our website. Your past orders can be viewed in the customer login area.
4. Delivery Conditions
In addition to the product prices, shipping costs apply. The applicable shipping costs are displayed in the offers. Delivery is made exclusively by mail. Self-collection is not possible.
5. Payment
The following payment methods are available in our shop (CH): PayPal, credit card, Postcard and Twint.
Refund of duplicate payments:
If a duplicate payment is made by the customer, we will of course refund the overpaid amount. However, for the administrative effort and possible bank charges incurred, we charge a flat processing fee of CHF 15.00 per case, which will be deducted directly from the refund amount.
6. Shipping and Transport Damage
Shipping is carried out exclusively by Swiss Post. The risk of loss or damage to the goods passes to the customer upon handover to Swiss Post.
Lian Chinaherb AG does not assume liability for transport damage or loss of the shipment. Any claims must be made directly with Swiss Post. We will support you as far as possible in asserting such claims.
7. Liability for Defects and Warranties
Our products are subject to the statutory liability for defects in accordance with the Swiss Code of Obligations (OR 197 ff.).
No additional warranty is granted.

8. Liability
We are fully liable for damages caused intentionally or by gross negligence, as well as for injury to life, body or health.
In the event of slight negligence in the breach of essential contractual obligations, our liability is limited to the typical, foreseeable damage.
Liability under the Swiss Product Liability Act (PrHG) remains unaffected.
Further claims for damages are excluded.
9. Data Protection
The protection of your personal data is important to us. The processing of your data is carried out in accordance with the Swiss Data Protection Act (DSG). Details on the collection, processing and use of your data can be found in our Privacy Policy on our website.
10. Applicable Law and Jurisdiction
Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for all disputes is the registered office of Lian Chinaherb AG, unless mandatory statutory places of jurisdiction prevail.
